Terms And General Letting Conditions
RENTAL
The lease is concluded with the different owner of each villa on the site, under the conditions set out below, which with the conclusion of the lease are considered tacitly accepted between the parties, unless different agreements are established from time to time between them.
HOW AND WHERE TO BOOK
The booking is direct with the owner, whose address is on the “information” page of villesulmare.com
PAYMENT
The booking is accepted upon payment of a deposit equal to 40% of the total rental price established between the parties. The balance payment must be made 30 days before the start of the rental period.
Upon receipt of the deposit (40%) the owner will send the customer a rental voucher (confirmation).
For reservations concluded less than 30 days before the rental period, the customer is required to pay the total amount of the rental price immediately.
MINIMUM RENTAL PERIOD AND PRICES
The minimum rental period, unless otherwise agreed with the owner, is one week (7 nights), from Saturday to Saturday. The weekly rates for each villa are indicated on the site on the “Rates” page.
ARRIVAL AND DEPARTURE TIMES
Unless otherwise agreed with the owner, the arrival/departure day is Saturday; Arrival time 4.30pm – 7.00pm, departure time 8.00am – 10.00am.
For any delays not previously agreed between the parties, the owner may charge the customer the price of one day’s rent (based on the rate applied at the time of conclusion of the contract).
ARRIVAL
Upon arrival, the customer must show the owner or his representative the documents of all guests who will stay at the property during the rental period and pay all payments on site (final cleaning, rental of bed/bath linen Euro 15.00 per person, tourist tax and security deposit).
MONEY DEPOSIT
The customer is required to pay the owner or his representative the sum of €250.00 (two hundred and fifty/00) in cash as a deposit, which will be returned to him on the day of departure, net of any ascertained damages.
The customer who does not pay the deposit will be refused entry into the house.
If the customer leaves the property before the end of the rental period, the owner or the person in charge is authorized to return the deposit (less the costs for any ascertained damages) only after having checked the inventory and condition of the rented accommodation.
NUMBER OF PEOPLE – SUBSTITUTION OF PEOPLE – PETS
Only the number of guests agreed upon at the closing of the rental contract and registered at check-in can stay in the facility.
In any case, the number of guests cannot exceed the number of beds indicated on the website www.villesulmare.com. An exception is made for children up to 2 years of age, by prior agreement with the owner.
If the aforementioned limit is not respected, the excess people will have to leave the facility. The owner or person in charge also has the right to retain the deposit.
No substitution of people is permitted during the rental period unless otherwise agreed with the owner. Pets are allowed. Any pet weighing less than 8kg is considered small. The size and type of pet must be communicated at the time of booking.
The customer is responsible and must supervise his pet at all times.
CLEANING AND WASTE DISPOSAL
The homes are delivered perfectly clean and tidy and must be returned free of any waste.
The customer is obliged to comply with local regulations for waste disposal. Conditions of which the owner will make him aware.
In case of failure to comply with these rules and failure to dispose of the waste, the owner will charge the customer €100.00 as the cost of disposal directly in the landfill.
The cost of final cleaning, unless otherwise agreed with the owner, is borne by the customer (100.00 euros – 130.00 euros for Casa Madre villa)
MAINTENACE OF THE EXTERIOR
If necessary, the owner or his representative reserves the right of access for any essential maintenance work (garden etc.)
CHANGES – CANCELLATIONS
For any changes to the booking, or for the transfer of the booking to other people, the customer will be charged Euro 50.00, provided that the villa and the rental period remain the same.
In the event of cancellation of the rental less than thirty days from check-in, the owner has the right to retain the entire sum paid by the customer up to that point.
The customer may be refunded, minus a 20% penalty, only in the case of partial or total re-renting of the villa to third parties for the canceled period. The refund will only take into account the re-renting period.
JURISDICTION
For any dispute connected to the booking or rental procedures, the competent court is that of Palermo and Italian law will be applicable.
Booking implies knowledge of the general contract conditions which must be accepted without reservations or exceptions. If any provision of this contract is or becomes invalid, or if a gap is discovered, the validity of the remaining conditions cannot be called into question.
INFORMATION ACCORDING TO ART.13, LAW DECREE 196/2003
The owner declares that the personal data acquired in the pre-contractual and contractual phase will be used exclusively for purposes related to: the stipulation of rental contracts, the booking procedure, the execution and correct fulfillment of the related contractual obligations. In the case of sensitive data (e.g. person with physical or mental disability), the data can only be used with the written consent of the interested party.
